Terms of Service

1. Acceptance of Terms

By creating an account or using PetalBoard (“Service”, “we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of Service

PetalBoard is an AI-powered Pinterest scheduling and content creation platform designed for Etsy sellers. Features include Pinterest pin scheduling, AI-generated captions and images, campaign planning, and Etsy shop integration. We reserve the right to modify or discontinue the Service at any time with reasonable notice.

3. Accounts

You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. We reserve the right to terminate accounts that violate these Terms.

4. Pinterest Integration

By connecting your Pinterest account, you authorise PetalBoard to create, read, update, and schedule pins on your behalf according to your instructions. You remain responsible for all content published through your Pinterest account. Your use of Pinterest through our Service is also governed by Pinterest’s Terms of Service.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe any third-party intellectual property rights
• Publish spam, misleading content, or content that violates Pinterest’s policies
• Attempt to reverse-engineer, scrape, or interfere with the Service
• Upload or generate illegal, harmful, or abusive content
• Resell or sublicense the Service without our written consent

6. Intellectual Property

PetalBoard and its original content, features, and functionality are owned by PetalBoard and protected by applicable intellectual property laws.

You retain ownership of content you upload or create using the Service. By uploading content, you grant us a limited licence to store, process, and display it solely to provide the Service to you.

7. Billing and Payments

Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by law. We may change pricing with at least 30 days’ notice to existing subscribers.

Credits (used for AI features) are consumed as described on our Pricing page. Monthly credits reset at the start of each billing cycle; bonus credits do not expire.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes.

9. Limitation of Liability

To the fullest extent permitted by law, PetalBoard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which PetalBoard is registered, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
